OGDEN, Utah (AP) -- An Ogden family has filed a federal lawsuit claiming police were wrong to gun down a 29-year-old man in an armed confrontation last December.

Police say they responded properly when they found Jesse Turnbow with a sawed-off shotgun and matching the description of a suspect in a street fight.

Turnbow's lawyer says Turnbow was ready to give up when he died in a hail of police bullets.

That account differs from the police and an investigation by the Weber County Attorney's Office that found Turnbow disregarded commands to drop his weapon.

The $30 million lawsuit was filed yesterday in federal court in Salt Lake City by Ogden lawyer Michael Studebaker.
