Dept. of Corrections: Man involved in officer shooting should have been in jail

SALT LAKE COUNTY -- The Utah Department of Corrections says the man involved in the shooting of a police officer Thursday should have been behind bars.

Troy Cabibi, 29, is accused of shooting a South Jordan police officer who was serving as part of a Joint Crimes Apprehension Team in South Salt Lake. Stevan Gerber was wounded as the team closed in to arrest Cabibi on parole violations.

Police say either Cabibi or another man in the apartment, Bradley James Olmos, fired two shots at officers. The investigation into who fired the shot that hit Gerber is ongoing. Cabibi and Olmos were arrested for attempted murder and could face federal charges.

Cabibi had been arrested on Aug. 18 on suspicion of driving under the influence, which should have been a parole violation that resulted in his being held in jail. Instead he bonded out, according to Unified Police Lt. Don Hutson.

Corrections officials say the jail notified a parole agent that Cabibi had been arrested. They say the agent asked the jail to hold Cabibi until a warrant -- needed to bring a parole violator back to prison -- could be issued.

But Cabibi bonded out before that happened.

Hutson points out a call from Cabibi's parole officer alone wouldn't have been enough to keep him locked up.

Hutson said, "We can't legally hold them. They've legally done what they need to do to be released from jail, and unless we have something that overrides that we can't hold that. It's against their constitutional rights."

Corrections officials say the warrant for Cabibi was filed as quickly as possible but, unfortunately, it wasn't enough to keep him in custody.
