SALT LAKE CITY -- A man charged with drunk driving and automobile homicide now faces a lawsuit.
Prosecutors say John Bishop was driving drunk in April 2009 when he slammed his vehicle into the back of another car, killing one of his passengers and injuring four others.
One of the men injured, Clifton Tolboe, is suing Bishop and claiming he was negligent in his actions.
The lawsuit also lists both men's employer, Global Marketing Alliance, as a defendant. The suit claims the company threw the party both attended before the crash and should not have allowed Bishop to leave intoxicated.
Tolboe is asking for medical expenses and general damages for physical and emotional pain and suffering.
