SALT LAKE CITY -- A man facing trial for a crash that killed another man wants a judge to set aside a vehicular homicide charge.

Prosecutors say John Bishop was under the influence of alcohol when he plowed his BMW into the back of another car on Interstate 80 in April 2009.
The impact killed 26-year-old Jason Palmer, who was riding in Bishop's car, and injured four other passengers and two people in the car he hit.
Wednesday afternoon, Bishop's attorneys will argue before a judge that the homicide charge should be quashed.
Bishop also faces charges of DUI and causing serious bodily injury.
