SALT LAKE CITY (AP) -- Prosecutors are fighting a defense motion to sequester the jury in the upcoming trial for the man charged with kidnapping Elizabeth Smart.

Prosecutors say the defense request would exclude professionals, the self-employed and parents of young children from the jury. Prosecutors filed motions yesterday in response to pre-trial motions filed last month by the defense.

Brian David Mitchell is scheduled to go on trial February first.

The prosecution team is also opposed to a defense request to tour the Smart home.
