SALT LAKE CITY (AP) — A judge has declined to toss racketeering and obstruction of justice charges against former Utah Attorney General John Swallow, who is on trial in an influence-peddling case.
Judge Elizabeth Hruby-Mills said in written rulings Friday that prosecutors have sufficient evidence to allow those charges to stick. She's expected to rule on eight other charges later Friday that include evidence tampering and bribery.
Swallow's attorneys requested that all the charges be dismissed for a lack of evidence after prosecutors on Thursday dropped three counts of money laundering, bribery and evidence tampering against Swallow after a key witness refused to testify.
Prosecutors rested their case Thursday. Swallow's defense attorneys are scheduled to begin bringing their witnesses to the stand on Tuesday.
