IDAHO FALLS, Idaho (AP) — An Idaho Falls man has been sentenced to 20 years in prison for shooting and killing his friend.
The Post Register reports 37-year-old Justin Sarbaum was accused of fatally shooting 32-year-old Tyson Tew in January 2017 after argument turned physical. He was charged with second-degree murder, but the charge was later reduced to voluntary manslaughter as part of a plea agreement.
Sarbaum says he acted in self-defense after Tew had punched him multiple times.
Sarbaum's lawyer Curtis Smith filed a motion Tuesday to withdraw the guilty plea, but District Judge Joel Tingey denied it.
Two years of Sarbaum's prison sentence are fixed and 18 are indeterminate.
Sarbaum apologized for what happened at his sentencing on Thursday, but maintaining that the shooting was an act of self-defense.
