SALT LAKE CITY (AP) — Three Utah State University officials have been dismissed from a lawsuit filed by a student who says she was raped at a 2015 fraternity party when she was 19.
The Deseret News reports Victoria Hewlett sued her now former university, three of its employees and the school's Sigma Chi Fraternity chapter in November 2016.
She says they knew of five previous allegations against her assailant before she was raped, but didn't take action.
A U.S. District judge found Friday that the three school officials are immune from legal action as state employees but the school itself wasn't dismissed from the suit.
A jury trial on the remaining claims is scheduled for May 2019.
The Associated Press does not name sexual assault victims but Hewlett has agreed to outlets identifying her.
