DENTON, Texas (AP) — A University of North Texas police officer will not face charges in the fatal shooting of student who was armed with an ax.

Prosecutors on Thursday said a Denton County grand jury declined to indict Cpl. Stephen Bean in the Dec. 13 death of 21-year-old Ryan McMillan.

Police say the officer felt threatened when he opened fire and shot McMillan. Bean was investigating reports of someone using a small ax to break the windows of several vehicles near the campus in Denton when he came upon McMillan.

Patrol car video recorded the officer several times ordering McMillan to back away. Police say McMillan continued to move toward the officer before being shot.

A grand jury in Denton no-billed the officer last week.
