WASHINGTON (AP) — Federal prosecutors say they won't pursue charges against a Metro Transit Police officer who fatally shot a man in a tunnel last year.
The U.S. Attorney's Office for the District of Columbia announced Thursday that officials concluded there wasn't enough evidence the officer used excessive force or had criminal intent in the shooting death of 35-year-old Bobby Gross.
Prosecutors say the officer responded to the Potomac Avenue station on March 12 after Metro personnel saw a man dressed in a T-shirt, boxer shorts, and no shoes running in the tunnel carrying a large branch.
They say Gross ran at the officer and hit her with the branch despite repeated warnings that if he didn't drop it, he would be shot. The officer shot Gross a total of five times.
