Cassia Schools settles civil suit in vice principal sex case

BURLEY, Idaho (AP) — A civil lawsuit filed by a former Burley High School student against the Cassia County School District has been settled.

A hearing scheduled for Jan. 4 has been vacated, with court notes indicating the case has settled, according to The Times-News (http://bit.ly/1YAk5O9 ). The terms of the settlement were not disclosed in court documents.

The girl and her parents filed the lawsuit after former Vice Principal Tara Bagley was convicted in July 2013 of sexual abuse committed by lewd or lascivious acts on a minor child 16 to 17 years old. Bagley was sentenced to two consecutive 4- to 13-year prison terms.

The Associated Press is not naming the girl because she is a victim of sexual assault.

The lawsuit was filed in Oct. 14 against Bagley, the district, Superintendent Gaylen Smyer, former Principal Carolyn Hondo and the school board. The district denied all allegations.

The victim's attorney, Keith Roark, wrote in the complaint the Bagley attended girls sporting events and was a chaperon for the victim's sports teams. He wrote that Bagley began making sexual advances during those events.

The lawsuit claimed that the district had numerous cases of staff sexually abusing students in the past few years and did not put a policy or program in place to safeguard students.

Bagley was the fifth sexual abuse case involving the school district to reach the courts since 2010. Only one was found not guilty of their charges.
