ST. GEORGE, Utah (AP) — A trial date has been set for a St. George man accused of fatally shaking his fiancee's 4-month-old son seven years ago.
The Spectrum reports (http://bit.ly/1XgU4NM) that a judge on Friday said the trial of 38-year-old Gregory Todd Fullerton will start May 2.
Judge Pamela Heffernan says she is committed to moving the case forward. Six other judges have handled the case before Heffernan was assigned it three months ago.
Fullerton was arrested in July 2008 after the baby was showed injuries consistent with shaken baby syndrome.
He has denied shaking the boy. But when questioned by investigators, Fullerton said he pressed on the infant's back and flip-flopped him around on a bed.
Defense attorneys say Fullerton was never read his Miranda rights.
