College of Southern Idaho asks for dismissal of VP's lawsuit

TWIN FALLS, Idaho (AP) — The College of Southern Idaho is asking the U.S. District Court to dismiss a lawsuit by a former vice president claiming discrimination based on her gender and national origin.

Edit Szanto filed the suit in July against the school's board of trustees, president and former interim president. She claims she was fired when she made claims about discrimination against her as a woman and an immigrant from Romania.

CSI filed a response to the lawsuit Wednesday, asking for it to be dismissed with prejudice, so it cannot be filed again, the Times-News reports (http://bit.ly/1LG8iEN ).

CSI's attorney Kirtlan Naylor wrote that allegations in Szanto's complaint "do not rise to the level of a deprivation of rights."

According to the complaint, Szanto was paid less than fellow male employees and was passed over for positions that she was qualified for. The complaint also alleges that Szanto was denied promotions.

Naylor wrote that the college denies all allegations made in the complaint. Szanto "failed to exhaust all available administrative remedies," Naylor wrote, saying CSI acted in a "reasonable and prudent fashion" to satisfy college, state or federal requirements.

In a second motion filed Wednesday, Naylor argued that CSI's board members must be dismissed from the case as the board does not have the capacity to be sued because it is not an independent entity.
