RALEIGH, N.C. (AP) — The 4th U.S. Circuit Court of Appeals has refused to reconsider its ruling that keeps alive a challenge of the Wake County school board election districts.
The News & Observer of Raleigh reported (http://bit.ly/1NLtkDT) that the court in Richmond, Virginia, ruled 2-1 in May to keep alive a challenge of the district lines. The full court has now refused to reconsider.
The lawsuit has been sent to a trial court for consideration. No trial date has been set.
Thirteen Wake County residents and two community organizations sued, saying the lines drawn by state lawmakers in 2013 violate "one-man, one-vote" requirements of the state and federal constitutions.
Those suing contend the new districts were drawn to increase the chances for suburban voters to return a Republican majority to the school board.
