SALT LAKE CITY (AP) -- One of the suspects in the Elizabeth Smart kidnapping case will appear in court this morning.
Brian David Mitchell is scheduled to be arraigned today, and a trial date could be set.
Earlier this week a judge ruled Mitchell competent to stand trial. And yesterday, a judge unsealed a grand jury indictment against him which cleared the way for the case to go to trial.
Mitchell and his wife face kidnapping, aggravated sexual assault, aggravated burglary and conspiracy to commit aggravated kidnapping charges. His wife has been found incompetent to stand trial twice and is undergoing treatment at a state mental hospital.
