SALT LAKE CITY (AP) — Prosecutors say a Utah woman accused of leaving her newborn baby in the trash should be sent to state mental hospital to see if treatment can make her competent for trial.
A judge decided last February that 24-year-old Alicia Englert's IQ is too low for her to face attempted murder charge in court.
Prosecutors say that court-ordered treatment hasn't worked so far and Englert should undergo a program at the Utah State Hospital.
But defense attorneys say she has an inherent intellectual disability and may never be competent to stand trial.
Authorities say Englert abandoned the infant born at home in August 2014 and the baby girl would have died if she wasn't found. The child recovered and is being adopted.
A hearing in the case is set for Thursday.
