Judge to rule on woman's probation bid in false threats case

ELIZABETH, N.J. (AP) — A New Jersey woman charged with making fake threats against fellow black college students will learn next month whether she can enter a probation program.

Union County prosecutors rejected Kayla-Simone McKelvey's request and instead offered to recommend that the Union Township woman receive a six-month jail term if she pleads guilty and pays restitution.

But her attorney wants a judge to overturn the decision and let her enter the pretrial program.

During a court hearing Wednesday, a judge set an April 8 hearing date for McKelvey's appeal.

McKelvey is charged with creating a false public alarm at Kean University.

Prosecutors say she participated in a Nov. 17 rally on racial issues there and then went to a campus library and tweeted anonymous threats against black students.

They say she returned to the rally and tried to raise awareness about the threats.
