School district paid $40,00 to settle student sex lawsuit

SIOUX CITY, Iowa (AP) — New court documents show the Sioux City Community School District has paid a total of $40,000 to settle a lawsuit brought by the mother of a student sexually exploited by a former educational specialist.

The school board earlier this month approved a $20,000 settlement agreement. Documents filed Thursday show the district's insurance carrier will pay another $20,000, the Sioux City Journal reported (http://bit.ly/1qRXRHL ) Saturday. The insurance portion was not earlier disclosed by the district.

The district's share of the settlement will be paid from its management fund, a taxpayer-funded budget section used to pay insurance premiums and legal settlements, Superintendent Paul Gausman said.

The lawsuit had accused the school district and IowaJAG Inc. of negligence in allowing Erick Deleon, 30, to have contact with the 16-year-old girl after school hours. Deleon was sentenced to three years of probation and a suspended five-year prison sentence for a count of sexual exploitation by a school employee.

Deleon and IowaJAG both reached separate settlement agreements with the mother, whose name was not used in court documents in order to protect her daughter's identity.

Those settlement amounts are confidential. The school district's portion of the settlement is public because it is a public, tax-funded entity.

The mother's attorney, Ed Keane, of Sioux City, has said he cannot disclose the total amount of the settlement
