Estate for Ohio woman mauled to death by dogs drops suit

DAYTON, Ohio (AP) — The estate of an Ohio woman fatally mauled by her neighbor's dogs has dropped its wrongful death lawsuit as the two sides work on a settlement.

Klonda Richey, 57, was fatally mauled outside her home by two Cane Corso mastiffs on Feb. 7, 2014. Police shot and killed both dogs when they attacked responding officers.

The dogs' owners, Andrew Nason and Julie Custer, were found guilty in Dayton Municipal Court of two misdemeanor counts of failure to control the animals.

Richey told acquaintances she had been harassed by the owners and built a high fence to protect her and her 20 cats, the Dayton Daily News previously reported. Richey also told other neighbors she lived in fear of the dogs.

Before the mauling, two area agencies fielded about 60 calls and complaints related to Nason's home between the end of 2011 and February 2014, records show.

Richey's estate sued Nason and Custer last year. The suit claimed they negligently failed to control their mastiffs and failed to protect Richey from the "known and foreseen" risk of attack.

The lawsuit sought damages of more than $25,000, attorney's fees and expenses, interest, costs and other relief.

Attorneys for both sides told the newspaper (http://bit.ly/1LbZ8zm ) they are negotiating a possible resolution. The suit can be refiled if no agreement is reached, according to the attorney for Richey's estate.
