RENO, Nev. (AP) — The 74-year-old Sparks man accused of murder in the shooting of an unarmed trespasser has decided against testifying on his own behalf in the case that has brought attention to Nevada's "stand your ground" law.
A Washoe County jury is expected to begin deliberations in Reno on Friday after lawyers on both sides present closing arguments.
The Reno Gazette-Journal reports (http://tinyurl.com/p5bvl3u ) Judge Patrick Flanagan asked Wayne Burgarello on Thursday whether he intends to take the witness stand.
Burgarello said he wishes to remain silent with the presumption of innocence.
He's charged with murder and attempted murder in the killing of Cody Devine and the wounding of Janai Wilson. He insists he was acting in self-defense when he confronted them in February 2014 inside a vacant, rundown duplex he owns.
