ELKO, Nev. (AP) — Elko police investigating a homicide two weeks ago say they've determined it was a justifiable case of self-defense and don't intend to file any charges against 28-year-old Frank Criswell.
Criswell told detectives he shot 32-year-old Clinton Hopper on May 3 after Hopper attacked him at the apartment of a woman police say had a relationship with Hopper.
Police Lt. Rich Genseal told the Elko Daily Free Press Friday (http://tinyurl.com/mv632dy ) cellphone records show Hopper had been stalking the woman. He says Hopper drove from near Sacramento to Elko and called her 60 times that night.
Police say Hopper entered the woman's apartment, hit Criswell with a skateboard and began choking him before Criswell shot him with a .45 caliber pistol.
Genseal says the whole sequence of events "leads to self-defense or justifiable homicide."
