AUSTIN, Texas (AP) — A special prosecutor handling an abuse-of-power case against former Texas Gov. Rick Perry says it has been complicated by an avalanche of paperwork.
In a filing to a state appeals court released Tuesday, Michael McCrum suggests the case has been marred by the defense's "continual attempts to resist getting to the facts."
He noted that for nine months both sides "have exchanged hundreds of pages of briefs" without resolution.
Perry left office in January. He has been indicted on allegations of abuse of power after threatening, then carrying out, a veto of funding for public corruption prosecutors.
Perry's attorneys have challenged the case's constitutionality.
McCrum's response argues that lower courts should be allowed to hear the case's facts before the constitutionality is challenged on appeal.
