STATE COLLEGE, Pa. (AP) — Former FBI director Louis Freeh will get the chance next month to argue that a defamation case against him by Penn State's former president should not be delayed.
The Centre Daily Times (http://bit.ly/1gASmp9 ) reports the state Superior Court will hear Freeh's expedited appeal May 20 in Philadelphia.
Ex-Penn State president Graham Spanier faces criminal charges for an alleged criminal cover-up of complaints about retired assistant football coach Jerry Sandusky.
Freeh produced a report for Penn State that criticized how Spanier and other administrators handled the Sandusky scandal.
That led Spanier to file a court notice that he planned to sue Freeh for defamation.
Spanier has sought to delay filing that lawsuit, arguing that his testimony in the civil case could harm his criminal defense.
Freeh wants to overturn a judge's decision allowing Spanier to delay the lawsuit.
