SALT LAKE CITY (AP) -- The constitutional fight over Salt Lake City's Main Street Plaza returns to a courtroom tomorrow.
Federal appeals judges in Denver will decide whether the city violated the First Amendment when it turned over control of the Main Street Plaza to the church in exchange for church-owned land elsewhere in the city.
A federal judge dismissed the lawsuit a year ago this month but the American Civil Liberties Union appealed. The A-C-L-U is claiming the judge focused on private property law without giving full consideration to First Amendment free-speech and religion provisions.
