Police arrest man in shooting death at West Valley apartment complex

WEST VALLEY CITY — A man suspected of shooting and killing an Ogden man at a West Valley apartment complex was arrested Tuesday night.

Dylan Gregorio Upshaw, 21, was booked into the Salt Lake County Jail for investigation of aggravated murder and obstructing justice.

Upshaw is accused of shooting Xavier Bernal, 20, at the Redwood apartments, 4000 S. Redwood Road, on Dec. 27. Bernal had arranged to meet someone at the apartments for an unknown reason, according to police. He drove there with a woman and a boy.

Once in the parking lot, he got out of his SUV and walked out of sight of the others. He returned a short time later with gunshot wounds, according to police. He got inside his vehicle and collapsed as the others drove him to a local hospital where he died from his injuries.

On Saturday, police named Upshaw as a person of interest in the case and asked for the public's help in finding him, while also noting that he was living at the apartments.

"A witness provided digital evidence to detectives that they believed was involved in the incident. .This evidence was tied directly to the scene," a police booking affidavit states. "Digital evidence that came from the scene was directly tied to Dylan Upshaw."

Police say they were given a recording of a witness "explaining Xavier went to meet (Upshaw) for a transaction, during that transaction an altercation occurred which resulted in Xavier being shot."

On Tuesday, investigators received a tip that Upshaw was at a local hospital with his girlfriend. Officers responded to the hospital and took him into custody. No explanation was immediately provided for why Upshaw was at the hospital with his girlfriend, but police say he was not injured. The girlfriend was not arrested.

Police believe Upshaw was planning on fleeing to Arizona, the affidavit states. The reason Upshaw and Bernal were meeting remained under investigation Wednesday.
