OGDEN — Police identified a man on Tuesday who they say was shot and killed before his body was found near the 21st Street Pond.

Ogden Police Lt. Tim Scott said Brian Racine, 28, was found near the pond shortly after 4 a.m. Thursday. Scott said Racine was from California but had been living in Ogden for about a month.

Cory Fitzwater, 35, was arrested in connection with Racine’s death Thursday night and booked into the Weber County Jail early Friday morning.

Fitzwater was linked to the shooting after police traced a .45-caliber bullet casing found near Racine's body to a .45-caliber gun confiscated during a traffic stop near the pond, according to a jail report filed on Friday. The traffic stop occurred about an hour before police responded to a report of a body at the pond, the jail report said.

The driver who was arrested in that traffic stop told police he saw Fitzwater "shoot the victim in the head with the gun that was found in the vehicle," the report stated.
