ATLANTA (AP) — Georgia's highest court has reversed a lower court decision, meaning a man who said his cancer was caused by exposure to asbestos has lost a Ware County jury award of more than $4 million.
The unanimous decision was announced Tuesday. It reversed a Georgia Court of Appeals decision, and found that an expert's testimony that the man's cancer was caused by asbestos exposure while working at a textile company's mill in Waycross should have been excluded by the trial court.
In a summary of the case, the court said Roy Knight in 2009 was diagnosed with malignant mesothelioma, a cancer most commonly caused by inhaling airborne asbestos fibers.
Knight and his wife had sued Scapa Dryer Fabrics, Inc. Knight had worked at its Waycross mill, doing sheet metal work in the late 1960s and early 1970s.
