LOGAN, Utah (AP) -- A driver accused of sending text messages just before a collision that killed two rocket scientists will take a plea deal Monday on charges of negligent homicide, his lawyer says.

Defense attorney Jon J. Bunderson told The Herald Journal of Logan he was able to negotiate a plea in abeyance for the 21-year-old driver, meaning the conviction could ultimately be erased from his record. There was no word from prosecutors.

Court documents say Reggie Shaw sent his last in a series of text messages just before his sport utility vehicle crossed a center line and clipped a four-door sedan on Sept. 22, 2006.

The impact caused the Saturn LS2 to crash into a Ford F-250 truck. James Furfaro, 38, and Keith O'Dell, 50, were killed in the Saturn on their way to work at ATK Launch Systems Group.

Court papers say even as Shaw was being interviewed by police investigators after the crash, he was still sending and receiving text messages.

The Herald Journal reports Shaw was served a summons for the charges on Aug. 21, 2007.
