OGDEN — A Perry man has been charged with murder in connection with the shooting death of an Ogden man during an apparent gathering of street racers in the county's far western reaches.
Michael Gaisbauer, 18, also faces eight counts of felony discharge of a firearm and a count of obstruction of justice, according to charging documents filed Tuesday in 2nd District Court in Ogden. He's being held without bail in the Weber County Jail.
During an interview with investigators, Gaisbauer "admitted to being on the scene early Sunday morning (Aug. 31) and firing a rifle eight times toward a crowd, which caused others to also start shooting. An individual was struck and killed during this incident," reads the affidavit in the case. The document says casings for multiple gun calibers were found at the site of the incident, including eight fired .300 Blackout cartridges.
The incident, called in to dispatchers about 1 a.m., occurred during an apparent clandestine street racing competition around 9350 West and 900 South in extreme western Weber County. An apparent argument by people at the gathering led to the firing of weapons by others and gunshot wounds to three people.
Jesus Cuadras Garcia suffered a gunshot wound to the head and later died, while the two other victims, including Cuadras' 5-year-old daughter, survived. The young girl suffered a gunshot wound to her leg and hip, while a second man suffered a gunshot wound to his shoulder.
Gaisbauer's girlfriend, McKinzi Sundquist, was arrested last week in connection with the matter for investigation of obstruction of justice. She has not been formally charged but remained in the Weber County Jail as of Tuesday.
Weber County Sheriff's Office investigators also said at the time of last week's arrests of Gaisbauer and Sundquist that the investigation into the incident continued and that they were trying to identify additional suspects involved.
The affidavit in Gaisbauer's case states that investigators placed the man at the scene of the incident after interviewing "multiple witnesses." He fled following the incident and threw his weapon into the Ogden River after driving through the Ogden Canyon. A dive team subsequently recovered the firearm, according to the affidavit.
Authorities have said little about what exactly transpired preceding the shooting, but a friend of the Cuadras family said he wasn't involved and that an argument involving others precipitated the gunfire. First-degree murder is a first-degree felony, while felony discharge of a firearm is a third-degree felony. Obstruction of justice is a second-degree felony.
