CEDAR CITY — A Utah man was charged Monday with trying to shoot his father before exchanging shots with police.
Brian Rush Peters, 40, is charged in 5th District Court with attempted murder, a first-degree felony; plus, two counts of discharge of a firearm and aggravated assault, third-degree felonies.
On Thursday, Cedar City police were called to 4254 W. 375 North after Peters called 911 and then handed the phone to his father, who said that his son had just tried to shoot him, according to a police booking affidavit.
The father later told police that he was sitting at his computer when he heard a "bang" and turned to see Peters holding a gun and about to shoot at him again, the affidavit states. "The father also said that (based on) where the bullets went into the wall, the bullets narrowly missed hitting him."
When he asked his son what he was doing, Peters replied that his "plan" was ruined, but never explained anything more about it, according to the affidavit.
The father also told dispatchers that his son was drunk.
Peters then called 911 a second time and "told dispatch that we would need SWAT and that there was going to be a lot of gunfire going on," according to the affidavit.
The father was able to take one gun away from Peters, but his son grabbed a second gun, pointed it at his father and told him to get out of the house, according to police.
Later, when an officer arrived and set up on the west side of Peters' house, Peters walked outside and fired a round at him while the officer was still next to a busy highway, the affidavit says.
"Officers were able to make phone contact with Brian and he told the officer speaking with him that if anyone came through the front door, he would shoot them. The officer on the phone told Brian he needed to put the gun down and to come out," according to the arrest report.
As a SWAT team was arriving, Peters came out of his house and pointed his gun at an officer, prompting the officer to shoot multiple rounds at Peters, the affidavit states. He was hit at least once and taken to a local hospital to be treated for his injuries and was later booked into jail. No officers were injured.
