(KSL News) A judge's ruling has cleared the way for a capital murder trial.
The judge ruled today that accused killer Floyd Eugene Maestas is not mentally retarded and is therefore eligible to face the death penalty if convicted.
Maestas allegedly killed 75-year-old Donna Lou Bott during a break-in and robbery at her Salt Lake home in 2004.
He's also charged with breaking into the home of an 83-year-old woman and robbing her that same night.
Prosecutors say Maestas has a 30-year history of beating and raping elderly women. His trial is expected to begin next month.
