Ragsdale makes court appearance

Sam Penrod reporting The man accused of gunning down his wife in the parking lot of an LDS Chapel in Lehi went back to court today.

It was a month ago today when Kristy Ragsdale was shot and killed. Her husband, David Ragsdale, was in court this afternoon to face the murder charges.

His family members also came to support him. "Our family is completely devastated by this tragedy, and I love and miss my sister-in-law Kristy very much. I miss her," said Tamara Ragsdale, David's sister.

It was a Sunday morning when Lehi police say that David killed Kristy on her 30th birthday. She was shot numerous times outside an LDS chapel. They had been separated, and Kristy was in the process of filing for divorce.

Prosecutors have not decided if they will seek the death penalty against David if he is convicted. That decision likely won't come for several more weeks. "These are difficult cases when it comes to evidence and procedures, and so we want to make sure we do this right; and when the time comes to make a decision about how to proceed, we make the right decision and we can back up that decision," prosecutor David Sturgill said.

Since the shooting, a custody battle has begun between the two families over the couple's two young children. The children are now with Kristy's family, but David's family expressed to us today they are hoping to have contact with the two boys.

The attorneys will meet a month from now in court to find a date for a preliminary hearing, when we will hear the evidence prosecutors have in this case.

Meanwhile, a Utah County judge has given approval for prosecutors to subpoena Kristy's cell phone records. Prosecutors say seven unheard messages on her voice mail could be submitted as evidence when David stands trial.
