(KSL News) Two young men allegedly assaulted by a Payson city councilman will not be charged.
Councilman Scott Phillips says he stopped the two as they were tagging his truck. But, the Salem City prosecutor says there is no evidence to support the graffiti claim.
Salem is handling the case because of a conflict of interest with Payson.
Phillips is charged with beating up the two men, although neither suffered any serious injuries.
He will enter a plea in court July 3.
