Man sentenced for shooting at retreating tresspasser

(KSL News) A Roy man who fired a gun at a backyard intruder pleaded guilty to aggravated assault.

Last July, Michael Wilder fired at an unarmed trespasser as the man fled and climbed a fence.

The man, who police say may have been under the influence of alcohol or drugs, was not hurt during the incident.

Yesterday the judge said deadly force can't be used when someone is running away. Wilder was sentenced to a year probation, 100 hours of community service and a fine.
