SALT LAKE CITY (AP) -- The Utah Supreme Court turned back a developer fighting to incorporate a ski resort town in Wasatch County.
A panel of justices threw out Dean K. Sellers' petition for direct relief this week. The panel had earlier ruled Sellers would have to bring his complaint first to Heber City's 4th District Court.
Sellers is trying to overturn a decision by Wasatch County to deny his November petition to incorporate 8,366 acres of land into a ski resort community similar to Park City.
Sellers wanted to call he town Aspen, Utah.
The effort was short-circuited by residents who filed a petition to annex their properties into the Town of Daniel instead.
