Woman sentenced to up to 15 years in baby's death

PROVO, Utah (AP) -- A judge has sentenced a baby sitter to one to 15 years in prison for the death of a Provo baby.

Daniella Ruiz was convicted in November in 4th District Court of child abuse homicide in the 2006 shaking death of 5-month-old Brandon Zamora. She was sentenced on Tuesday.

Ruiz, 27, had said the baby was brought to her asleep and later became pale and unresponsive. The baby was hospitalized and died the next day.

Judge David Mortensen said the case was too serious for probation, despite Ruiz's pleas that she not be sent to prison because she has children.

Prosecutor Chad Grunander says it can be difficult to recommend prison but that in this case it was deserved.

Ruiz's attorney, Shelden Carter, plans to appeal. Ruiz has maintained her innocence.
