(KSL News) -- A judge today declared a mistrial in the case of an alleged polygamist accused of kidnapping one of his wives.

Prosecutors say Thomas V. Barlow forced the woman and one of his children into a pickup truck in the town of Hilldale two years ago.

His attorneys claim Barlow was just trying to rescue his family from the FLDS Church compound after he was excommunicated.

A paramedics report was filed after the incident, but neither prosecutors or defense attorneys were given a copy of it until after the jury had been seated, causing the mistrial.
