OGDEN — A Perry man was sentenced to at least four years and up to 10 years in prison for his role in a deadly shooting incident last year at a clandestine Weber County street racing event that left one man dead and two others injured.
Second District Judge Matthew Hansen on Wednesday sentenced Michael Robles Gaisbauer, 19, to a term of one to five years in prison for a reduced charge of attempted manslaughter, a third-degree felony, in the Aug. 31 incident that left Jesus Cuadras Garcia dead. Cuadras' young daughter, Ximena Cuadras Ambriz, and another man were injured but survived.
Robles was also sentenced to eight terms of three to five years in prison for eight counts of felony discharge of a weapon, a third-degree felony. The felony discharge sentences were ordered to run concurrently with each other but consecutively to the manslaughter sentence, resulting in potential prison time of between four and 10 years. Hansen granted him credit for 267 days served.
Robles pleaded guilty to the charges as part of a plea deal. The attempted manslaughter charge was reduced from a first-degree felony to a third-degree felony as part of the agreement. He had initially faced a charge of murder, a first-degree felony, but that was reduced to attempted manslaughter in the course of court proceedings.
A charge of obstruction of justice, a second-degree felony, was dismissed as part of the deal.
The Aug. 31 incident occurred on 9350 West just north of 900 South in western Weber County. During a street racing event, multiple people, including Robles, fired weapons in response to an altercation at the event, leading to the death of Cuadras and the injuries to the two others, all of them spectators.
Robles "admitted to being on the scene early Sunday ... and firing a rifle eight times toward a crowd, which caused others to also start shooting," his plea statement says.
Christian Elias Antonio Ruiz, 18, is charged with murder, a first-degree felony; two counts of felony discharge of a firearm, a third-degree felony; and three other counts in the matter. Ruiz allegedly told a witness interviewed by Weber County sheriff's investigators that he was firing a weapon during the incident. His case is still winding its way through court and a hearing in the matter is set for June 2.
A third suspect, 15 when the incident occurred, has been charged with murder in 2nd District Juvenile Court. Prosecutors have said they would seek to try the teen, now 16, as an adult.
Eli Keddington, of Centerville, pleaded guilty in November to attempted obstruction of justice, a third-degree felony, in the case and was sentenced to the time he had already served.
