DRAPER — A Draper man hurled a racial slur at a neighbor boy, then attacked his father with a "stun cane" in a confrontation over his comments, charges filed Monday allege.
Mark Olic Porter, 57, faces a third-degree felony aggravated assault charge in 3rd District Court for allegedly attacking a neighbor who had come to the defense of his son after overhearing a confrontation Nov. 3 at 169 E. Wasatch Point Lane.
Porter also is charged with class A misdemeanor assault against a police officer; interference with an arresting officer, a class B misdemeanor; and intoxication, a class C misdemeanor, in connection with the case.
A witness told police she heard Porter "loudly making racist comments to another neighbor's child," according to court documents.
"The child's father … approached and told Porter not to speak like that to his son," charges state. "Porter then hit (the man) with something and it sounded like (he) was being shocked. (The man) was thrown backward onto the sidewalk."
The boy's dad later told police he heard Porter shouting "get out of here (N-word)" to his son, "who was riding his scooter in a common area" of an apartment complex, court documents say.
"(The man said he) told Porter not to yell at his son. Porter then reached over the railing and hit (the man) with a stun cane," charges state.
The man later reported he received a shock from the object, but was able to wrestle it away from Porter.
Police officers were called to the scene, at which point Porter came out of his residence and claimed the man who he allegedly attacked had stolen his cane, court documents say. A Draper police officer reported that Porter "smelled of alcohol."
Porter allegedly struggled with two Draper police officers, at one point knocking off a female officer's body camera and elbowing her.
"Porter continued to yell at officers and threatened to defecate while in the back of the patrol car, which he did," charges state.
Jail records show Porter has bailed out of the Salt Lake County Jail. Prosecutors requested a warrant for his arrest Monday.
A search of court records indicates Porter has no prior criminal history in Utah.
