SALT LAKE CITY (AP) — A Provo man accused of trying to bring an explosive device into the federal building in Salt Lake City is set to be released from jail as he awaits trial.

Court records show U.S. Magistrate Judge Evelyn Furse decided Monday to release 33-year-old Brandon Bushnell after a mental health evaluation, though she required him to wear a GPS tracking device.

Prosecutors say Bushnell had a device known as a cricket bomb in his pocket when he arrived for a Social Security Administration hearing in November.

A security guard found the device and the building was evacuated. No one was hurt.

Defense attorney Stephen McCaughey says that Bushnell forgot he had the small device in his pocket and isn't dangerous.

Bushnell is facing one count of unlawful possession of an explosive inside a federal building.
