Ragsdale attorney files lawsuit against doctors, clinic

PROVO -- David Ragsdale pleaded guilty and was sentenced to prison for shooting and killing his wife, Kristy, in a Lehi church parking lot in January of 2008. But a lawsuit filed Monday claims it wasn't his fault.

Ragsdale is serving 20 years to life for the murder and won't have his first parole hearing until 2038. By then, Ragsdale will be 67, and his two young sons will be in their 30s.

The minor children, listed as B.R. and C.R., are plaintiffs in the lawsuit. Nurse practitioner Trina West, Dr. Hugo Rodier and Pioneer Comprehensive Medical Clinic are all listed as defendants.

The lawsuit claims West was negligent in prescribing steroids testosterone and pregnenolone, as well as the psychostimulant drug Concerta. It also claims that Rodier was negligent by not having required consultations with the nurse practitioner about the drugs she was prescribing.

Finally, Pioneer Comprehensive Medical Clinic is labeled as negligent for not properly monitoring the treatment of David Ragsdale.

The lawsuit claims the failures were a direct, proximate and foreseeable cause of the conduct that led to the shooting, as well as the death of Kristy Ragsdale. [CLICK HERE to read the entire lawsuit]
