OGDEN — One of two men accused of taking part in a Roy shooting in March was sentenced to eight months in jail on Tuesday.
Izack Martinez, 20, of Roy, was sentenced Tuesday and given 60 days of credit in previously served jail time. Martinez pleaded guilty in March to two counts of felony discharge of a firearm, a third-degree felony.
In return for his pleas, prosecutors dismissed multiple third-degree felonies, including one count of felony discharge of a firearm, one count of obstructing justice and three counts of possession or use of a firearm by a restricted person.
Martinez and another man, 19-year-old Raymond Garcia, were charged March 9 with a shooting in Roy that took place days earlier.
Around 2:30 a.m. on March 6, Roy police were sent to a home along 2325 West after reports of a shooting. Charging documents allege that gunshots could be heard on the call, and the caller mentioned Garcia's name. Police later learned that a verbal altercation led to a fight, then gunshots rang out. Police believe that a green car hit a mailbox while fleeing from the scene of the shooting.
After the shooting, police were given a video showing the green car parked. The video later showed people screaming and multiple people getting into another car before driving away. Police say the second car drove to an Ogden hospital where one person was treated for a gunshot wound to their side.
Police later received a call that a car matching the description of the car at the shooting was found nearby in Roy. The car was missing a driver's side window, which police were told from a witness to the shooting that the car lost the window while driving away. A gun could be seen in the driver's seat of the car, the charges state.
The car was parked close to the area where Garcia and Martinez live, and police served a search warrant on the home on March 6, the same day as the shooting. Police reported finding three guns, ammunition, magazines, spent shell casings and bloody clothing, among other items. The guns were found in different air vents around the house, charging documents say.
Garcia and Martinez called police on March 8 and requested to meet at the Roy Police Department. Martinez told police he fired his gun three times and would have kept shooting if he had more bullets, according to the charges.
Garcia allegedly told police that he ran out of the home on 2325 West when a group of people started shooting at his car. The car later crashed into a mailbox, and Martinez later began shooting. Police say Garcia told them there were multiple people in the car, and when they got home they stashed the guns in the vents.
As of Wednesday, Garcia's case was still ongoing and his next court appearance is set for May 31. Garcia is being held without bail at the Weber County Jail. Martinez is also being held in the Ogden jail to serve his sentence.
