SALT LAKE CITY, Utah (AP) -- The Utah Supreme Court has agreed to decide if there is a conflict of interest between an inmate accused of killing a prison guard and his court-appointed attorneys.
Curtis Allgier is charged with capital murder in the 2007 shooting death of Stephen Anderson during a medical visit to University Hospital.
The Salt Lake Legal Defender Association asked for the review based on claims that Allgier's defense team "failed to preserve evidence as requested" by him.
The motion filed in 3rd District Court also said his attorneys disclosed unauthorized information that could prejudice potential witness testimony.
Last year the LDA asked that its entire office be removed from the case because several attorneys were friends of Anderson.
Judge Deno Himonas allowed one of the defense team members to withdraw but ruled the relationship of others wasn't that close.
