PROVO, Utah (AP) -- A judge had granted a motion to dismiss the appeal of a death row inmate convicted of killing a woman during a home robbery in 1985.
Fourth District Court Judge Lynn W. Davis says Douglas Carter's claims that he received ineffective legal assistance after his initial conviction were without merit. Davis on Monday granted the state's motion to dismiss Carter's petition for post-conviction relief.
Carter was convicted in 1985 of the first-degree murder of Eva Olesen, 57, during a robbery at her Provo home. Olesen was stabbed 10 times and shot in the head.
Carter was sentenced to death twice for the crime, first in 1985 and again in 1992 by a second jury that reheard the penalty phase.
Arguments in the case were delayed last year when Carter's attorneys quit.
