SALT LAKE CITY — Two West Valley men were charged Wednesday with raping an 18-year old woman in September.
Ricardo Hernandez, 22, is charged in 3rd District Court with object rape, a third-degree felony, and forcible sexual abuse, a second-degree felony. Eddie Herrera Derbyshire, 22, is charged with forcible sodomy, a first-degree felony, and two counts of object rape, a third-degree felony, and furnishing alcohol to a minor, a class B misdemeanor.
On Sept. 27, police say Hernandez, Derbyshire and a third unknown man picked the woman up to drive her to street races. As soon as the woman got into the car, one of men handed her a beer.
As the night progressed, the men continued to pressure the 18-year-old to drink alcohol, but when she refused, Derbyshire grabbed the woman’s neck and forced her to drink, according to charging documents.
The woman began to fade in and out of consciousness as the three men laughed, the charges state. Then, as she started vomiting out of the car window, the trio allegedly started raping her. Charging documents say the woman repeatedly told them to stop and tried to pull away but was overpowered.
Hernandez is accused of filming Derbyshire raping the woman on his cellphone. Hernandez admitted to police that the woman was intoxicated and unable to consent, according to the charges.
Bail was set at $500,000 for Hernandez. Derbyshire, who is on felony parole for attempted robbery and witness tampering, was denied bail.
