PROVO, Utah (AP) -- A woman accused of killing a five-month-old baby has NOT yet been arrested for the crime.
That's because prosecutors believe Daniella Ruiz is NOT a risk to anyone else. They also say there's no indication she's going to skip town.
The 24-year-old was in court for the first time on Friday to face a charge of first-degree murder. Authorities say it's rare for someone to be free on a first-degree murder charge.
Back in January, Ruiz was baby-sitting the child, when she called police to report the boy was NOT breathing. The baby was taken to the hospital, where medical examiners determined the injuries were consistent with a shaken-baby incident.
The infant died the next day.
Ruiz will remain free until her next court hearing on June first.
