CARSON CITY, Nev. (AP) — The firing of a Nevada Highway Patrol sergeant in 2011 for sexting a dispatcher is being upheld.
The Las Vegas Review-Journal reports (http://bit.ly/29DtP4Q) that a state hearing officer sided against former NHP Sgt. Kenneth Twiddy in a hearing Friday.
The ex-sergeant was fired for sending photos of his penis to a dispatcher in 2008.
But the Nevada Supreme Court ruled that there should have been a reassessment of whether the agency had met the burden of proof in dismissing Twiddy.
An attorney for Twiddy had argued the photos were sent to the dispatcher's private cellphone and that she didn't object since she sent him nude photos too.
Hearing Officer Paul Lychuk reaffirmed Twiddy's termination.
Lychuk says Twiddy was a supervisor who engaged in egregious conduct on several occasions.
