Highlights:
12-1163 Highmark Inc. v. Allcare Health Management Systems. The Patent Act provides that a "court in exceptional cases may award reasonable attorney fees to the prevailing party." At issue here is whether a district court's exceptional-case finding based on its judgment that a patent-infringement suit brought by Allcare against Highmark was objectively baseless is entitled to deference.
12-1184 Octane Fitness, Llc V. Icon Health & Fitness, Inc. In a patent-infringement case, whether a federal appeals court's ruling raised the standard for accused infringers to recoup attorney fees, thereby encouraging patent plaintiffs to bring frivolous patent cases to cause competitive harm or coerce unwarranted settlements from defendants.
