LAYTON — A Clinton man will spend two days in jail after hitting a Layton High School student in a crosswalk earlier this year, killing her.
Leroy Clark, 32, of Clinton, pleaded guilty Tuesday in Layton Justice Court to careless driving, a class C misdemeanor, and failure to yield to a pedestrian, an infraction. He was charged in March following the death of 17-year-old BaiLee DiBernardo, a junior at Layton High School.
DiBernardo was walking with another student in a crosswalk at 199 N. Fort Lane, about 75 yards away from the school, when they were hit by a pickup truck driven by Clark. DiBernardo was taken to Davis Hospital and Medical Center, where she was pronounced dead. The other student was taken to McKay-Dee Hospital in Ogden in serious condition and later recovered.
Layton Attorney's Office spokesman Steve Garside said at the time the charges were filed that Clark had just dropped something, possibly a drink or food item, and was reaching to pick it up when he hit both students.
Another driver, Julia Nielson, 38, of Layton, was driving a Dodge Durango behind the pickup and also ran over DiBernardo.
Neilson pleaded not guilty Tuesday to failure to keep a proper lookout, a class C misdemeanor. She is scheduled to return to court May 17.
In addition to two days in Davis County Jail, Clark was sentenced Tuesday to 58 days of home confinement and probation, was ordered to complete a defensive driving course, and must pay a $700 fine.
