LOGAN, Utah (AP) — A Logan police officer facing jail time on a weapons charge is asking a judge to dismiss the case.
Prosecutors say 33-year-old Jacob Boehme fired a weapon too close to a barn while hunting last November in violation of state law.
But Boehme's attorney, Bret Rawson, says it's not illegal to shoot near a barn that doesn't have animals in it. Rawson also argued during a hearing Tuesday in Utah's 1st District Court that Boehme had permission to hunt on the property.
The law covers barns where domestic animals are fed or kept. Prosecutor Dustin Ericson says the Legislature didn't specify a time.
The Herald Journal reports that the shooting took place just south of Nibley at a time when law enforcement officers were exempt for certain weapons violations.
